Maharashtra Industrial Development Corporation (MIDC) is the nodal investment promotion agency under the Government of Maharashtra. It provides businesses with infrastructure such as land, roads, water supply, drainage facilities, street lights, etc.

❖Allotment of Plot and handing over Possession

The minutes of the Land Allotment Committee will be published on MIDC's website. The applicant who is qualified and is allotted a plot of land and who has paid 5% EMD will receive an offer letter asking him to pay 20% EMD within 15 days from the date of receipt of the offer letter.

❖Execution of the lease deed, adjudication of stamp duty, and registration of the lease at the office of the sub-registrar

Stamp duty India is a tax, much like the sales tax and income tax that are collected by the government. All such taxes must be paid in full and on time. If you delay the payment, then you have to face the penalty. A penalty involves a fine or even imprisonment. If you want to produce any instrument or document in court, it needs to be done on stamp paper only. Then it is considered valid and can be used as evidence. The court cannot admit instruments or documents that are not properly stamped as evidence. If you want to know the market value of your property and the stamp duty amount on it, you need to contact the Ready Reckoner as follows:

  • You should know the division/village name and C.S. /C.T.S. number of your property.
  • From the Ready Reckoner, locate your valuation zone and sub-zone with the help of the division/village name and C.S. /C.T.S. number of your property.

From the table, know your rate per square meter, then multiply the rate by the built-up area of your property in square meters. You will get value. Reduce or increase this value for lift and depreciation as per the valuation factors given in the Ready Reckoner, and you will get a market value. Find out the stamp duty amount applicable to you as per the market value. The office of the Superintendent of Stamps Department also does this procedure for you for a nominal fee.

❖Approval of the factory building plan

If you are an industrialist, you may be looking to open a new factory. This may be an extension of existing plants or a new installation altogether. The building plans need to be approved by the competent authority prior to the construction of the plant. For instance, in the case of Delhi, the Directorate of Industrial Safety and Health, Government of Delhi, is responsible for conducting all procedures related to the process of factory registrations in the state.

❏Who is eligible to take approval for factory building in India?

An industrialist who employs at least 20 workers or more with the use of power in the factory, or an industrialist who employs at least 40 workers or more without the use of power, needs to get approval for a factory building.

MSEDCL supplies electricity to a staggering 1.86 crore consumers across categories all over Maharashtra, excluding the island city of Mumbai. There are about 1.31 crore residential, 30 lakh agricultural, 13.46 lakh commercial, and 2.5 lakh industrial consumers in the MSEDCL area, which fetches an annual revenue of about Rs. 33,000 crore. Water is provided by MIDC in case the land is in the MIDC Industrial Estates; else, it is provided by the Municipal Corporation for the non-agricultural (NA) land.

❖Fire NOC Provisional and Final

❏Provisional Fire Approval

Information about the procedure and A comprehensive list of documents required for obtaining "Provisional Fire Approval".

✜The applicant has to register online through the MIDC single-window portal (application form for building plans, provisional fires, temporary water connections, and external drainage connection approvals combined through BPAMS).

✜The applicant has to complete a one-time verification registration at the respective regional office of MIDC.

✜Once registered, the applicant uploads an application online for Provisional Fire Approval (combined) through BPAMS.

❚The applicant has to upload the below-mentioned Fire Service primary and additional documents online:
  • MPCB's documents or consent to establish.
  • List of raw materials and finish goods (storage quantity) on letterhead duly signed and stamped.
  • Process Flow Chart on letterhead duly signed and stamped.
  • Approvals under different Acts such as chief control of explosive for storage of hazards goods, gases and solvents under Petroleum Act and Rules, approvals from Civil Aviation and the authority / defence authority for building height near airport areas (If applicable).
  • In the case of existing company-approved building plans, approval accorded by MIDC and a copy of the Building Completion Certificate.
  • In the case of an existing company or factory, Form-B is issued by the licensing agency along with an Annexure as per the Maharashtra Fire Prevention and Life Safety Measures Act, 2006, and Rules 2009.                

✜After completing the application and uploading the document, submit the application online.

✜The application will automatically be forwarded to the concerned authority. (Forwarded to the respective Divisional Fire Officer, MIDC, of that region.).

✜The proposal is scrutinized on the basis of Acts and Rules made applicable: (i) The Maharashtra Fire Prevention and Life Safety Measures Act, 200S, which mandates the fire and life safety requirements of National Building Code Part 4 ii) Provisions of the Development Control Rules of MIDC, 2009.

✜A demand note for making payments towards Fire Protection Fund Fees or Additional Fire Protection Fund Fees will be generated online. After payment, the Provisional No Objection Certificate will be uploaded online, which can be downloaded by the owner or architect.

❏Final Fire Approval

Information about the Procedure and Comprehensive list of documents required for obtaining "Final Fire Approval".

✜The applicant has to register online through the MIDC single window portal (final fire approval) through single window clearance.

✜The applicant has to complete a one-time verification or registration at the respective regional office of MIDC.

✜Once registered, applicant uploads application online for Fire Approval through Single Window Clearance.

✜The applicant has to upload the mandatory documents online:

  • Architect area statement and approved copy of drawing by SPA MIDC.
  • As per the per the built area statement issued by the architect or competent authority (if there is any variation from the then-approval plans by MIDC).
  • Payment receipt of the differential amount for the additional area is any (other than the approval plan).
  • Form-A of the license agency, along with Annexure, as per the provisions of the Maharashtra Fire Prevention and Life Safety Measures Act, 2006.
  • BPAMS application number at the time of building plan approval or Provisional No Objection Certificate (if applicable).

✜After completing application and uploading document submit the application online.

✜The application will automatically be forwarded to the concerned authority. (Forwarded to the respective Divisional Fire Officer, MIDC, of that region.)

✜The final fire approval will be uploaded to the to the online website.

✜The online system provides the facility to upload the approved circular from the site, and the registered architect or company can download it from the website.

❖Installation of Fire Protection Systems for MIDC and Municipal Corporation area also

As per Section 21 of the "Maharashtra Fire Prevention and Life Safety Measures Act, 2006," The responsibility of maintaining fire and emergency services is that of the planning authorities', i.e., local authority or planning authority. In the state of Maharashtra, the subject of fire services is the basic responsibility of urban local bodies such as municipal corporations and municipal councils. For developments beyond the municipal areas, the responsibility rests with organizations such as MIDC, CIDCO, SEZ's, private townships, etc.

You will need to approach the appropriate department, as mentioned above, for any of the fire services. For example, if your property or land falls under the jurisdiction of MIDC, MIDC will provide you with fire services. If MIDC does not have a fire station in your area, then a local body will provide fire protection. If your property falls under the jurisdiction of a municipal council or corporation, then planning authorities will provide fire services.

The law relating to a partnership firm is contained in the Indian Partnership Act, 1932.Under Section 58 of the Act, a firm may be registered at any time (not merely at the time of its formation but subsequently also) by filing an application with the Registrar of Firms of the area in which any place of business of the firm is situated or proposed to be situated. Under Section 59 of the Act, when the Registrar of Firms is satisfied that the provisions of Section 58 have been duly complied with, he shall record an entry of the statement in the Register of Firms and issue a Certificate of Registration.
